摘要：在我国建筑市场中，工程质量保证金不能按时足额返还的现象屡见不鲜。基于风险管理理论，从现有文献中识别出阻滞工程质量保证金按时足额返还的两类风险，分别为质量保证金制度缺陷风险和质量缺陷责任界定风险；然后分析两类风险产生的根源，同时提出两类风险的应对措施，以期更大程度地解决质量保证金不能按时足额返还的问题。

Abstract：In the construction market of our country，the phenomenon that contractors can not return retention money in full and on time is common. Based on the theory of risk management，this paper identifies the two types risk of that retention money can’t be returned from the existing literature，namely quality guarantee system defect risk and quality defects liability defines risk. Then，analyzes the root of the two types of risk，puts forward response measures to two types of risk，in order to further solve the problem of retention money can’t be returned in full and on time.
