[摘　要]　通过案例来阐述承包合同双方当事人对开工日期及竣工日期常见的争议，并根据相关法律和示范文本的规定以及工程实务界和法院对开工和竣工日期之相关见解，论述如何确定这两个时点。最后提出了几点建议，以期对工程管理和法律工作人员有所助益。

Abstract: Based on some typical cases, the common conflicts and disputes about commencement date and time for completion of the two parties are stated, then this paper discusses the determination of the two time points according to related laws, model contract and the opinions of engineering practitioners and court. Finally it gives some suggestions in order to be helpful for the project management and legal staff.
