[摘　要]　阐述了我国工程造价司法鉴定的性质，总结了现阶段工程造价司法鉴定的难点，并提出工程造价司法鉴定中首先要遵偱从约原则；其次，对事实有争议的部分应采取造价单列的形式，避免以鉴代审；同时，应把握技术路线和工作程序，以确保鉴定结论的合法性；此外，造价鉴定应尽量避开对质量进行鉴定。

Abstract: This paper elaborates the nature of project cost judicial appraisal in China, sums up the current difficulties in this area, and proposes we should abide by the contract at first. Secondly, to avoid the audition being replaced by identification, we should offer cost breakdown for controversial portion. At the same time, it should grasp the technical route and working procedures to ensure the legitimacy of audit conclusion. In addition, the cost identification should not handle with the project quality.
