摘要：在总结相关研究的基础上，围绕《建筑工程施工转包违法分包等违法行为认定查处管理办法（试行）》关于违法分包的8种情形，基于违法分包前提条件认定、主体资格认定和违法分包范围认定三个维度，识别违法分包“问题表现-认定依据-认定办法”的认定路径，并对认定后违规主体的处理方法和程序进行梳理。

Abstract：On the basis of summarizing the related research，the paper centers the eight illegal subcontracting of “the identified management methods of construction subcontracting and illegal subcontracting and other illegal activities in construction engineering（tentative）”，then based on three dimensions of illegal subcontracting identified about preconditions，main qualification and range，recognizes the illegal subcontracting identified path of different dimensions of “performance issues-identified basis-identified measures”，and finally processes the methods and procedures for illegal bodies.
