摘要：针对缺陷责任期内工程损失引起索赔的问题，通过文献研究并结合13版《施工合同范本》中相关规定，剖析缺陷责任期内引起工程损失的原因以及责任划分，寻求非承包人原因和承包人原因引起的工程损失的索赔机会点，提出非承包人原因引起的工程损失的索赔的计算原则和计算方法以及缺陷责任期内发包人可以提出索赔的索赔补偿形式。

Abstract：In view of the problem of the project damage which leads to engineering claim in the defects liability period，through literature research and combined with the provision for engineering claim during the defects liability period based on the construction contract for construction project（model form）（GF-2013-0201），the paper deeply analyzes the cause of the damage of project and the division of responsibilities，seeks the opportunity points of engineering claim caused by contractor and non-contractor. Then，puts forward the calculation principle and method of engineering claim caused by non-contractor and the form of compensation claim caused by contractor in the defects liability period.
