[摘　要]　参照国家有关招投标法规，结合建设工程招投标工作的实践经验，从招标文件条款规定、开标后答疑澄清、招标结束后投标技术方案的使用、招标代理服务费支付等四个过程，对招标方的多种不合理行为进行了举例分析与探讨，涉及工程量变更、投标保证金、评标准则、招标文件发售、变相垫资、风险转嫁、技术方案及服务费等方面，为进一步规范招投标管理工作提供参考。

Abstract: With personal practical experiences and referring to applicable national laws and regulations of bidding, illustrates and analyses some unequal behaviors of the tenderees during tendering which occurred in such processes as regulating tender terms and conditions, clarificating after tender opening, using of bidder's technical plans and payment to the bidding agency. The unequal behaviors are related to variation of quantities, bid security, bid evaluation criteria, bid documents purchase, bid negotiation, capital financing, risk transfer, technical plans and the fee of biding agency. This paper will provide reference for further standardizing the management of the bidding.
