[摘　要]　立法矛盾与听证制度缺失，政府角色错位导致公平欠缺，司法制度设计缺陷，补偿标准滞后，是房屋拆迁存在的突出问题。完善拆迁立法，科学界定政府职能，加大拆迁纠纷的司法救济力度，是解决拆迁问题的有效途径。

Abstract: There are many prominent problems in house relocation. They are legislation contradiction, lack of the hearing system， the dislocation of the government role which has caused the lack of fairness， flaw of the legal system design and the delay of the compensation standard. Puts forward some ways to solve the house relocation problems including improving legislation of house relocation， defining the government role scientifically and strengthening judicial relief in house relocation disputes.
