摘要：针对目前建设工程合同实施过程中普遍存在的权利义务不对等问题，从合同条款细节设计、实施运作方面进行了详细的原因剖析，并从完善建设工程市场管理体系、选择投标策略、设置合同专项条款、合同具体操作实施等方面提出了相应的措施与建议。

Abstract：For the rights and obligations unequal problem in the implementation process of the construction project contract，analyzes the reasons from the detail design and operation of the contract terms. Then，puts forward the corresponding countermeasures and suggestions from perfecting construction market management system，selecting bidding strategy，setting up the contract special provisions and the operation and implementation of contract.
