摘要：从私法权利的视角对共有产权住房中购房人所获得的部分产权的权利结构和法律性质进行研究。认为部分产权是权利人一种对保障房占有、使用、收益和有限处分的、颇具本土特色和政策色彩的新型物权，其内在机理是通过交易过程中的权利结构变动引发权利的性质和功能改变，从而实现其独特的住房保障制度功能。部分产权在微观法律构造上呈现政府或单位享有保留所有权、购房者享有所有权期待权的权利分化样态。为符合物权法定原则要求，应通过单行立法或者法律解释，把部分产权明确规定为法定物权。

Abstract：From the perspective of private law rights，studies the rights structure and the legal nature of part ownership rights in obtained common property housing. This paper think，the part ownership in the indemnificatory housing system is a kind of new real right，which is characterized as rights to possession，use，earnings，limited disposition，local characteristics and policy color. Through the right structure in the transaction process changing，its mechanism causes the right nature and functions changing，so as to achieve its unique housing security system functions. Entitled to retain ownership，property buyers enjoy the right to state ownership differentiation of expecting rights the government or unit shows part of the property law in microcosmic structure. To meet the requirements of legal principle of property rights，should be through special legislation or legal interpretation，stipulate the part of the property law as legal real right.
