摘要：根据《建筑法》、《建设工程质量管理条例》和《建设工程安全生产管理条例》中对于监理单位及监理工程师义务与责任的规定，分别梳理出监理工程师的刑事法律风险、行政法律风险和民事法律风险；并就其风险的成因进行了分析，提出了以事先防范和过程控制为主，以事后救济为辅的法律风险防范理念。

Abstract：Construction Law of the People’s Republic of China，Regulation on the Quality Management of Construction Projects and The Administrative Regulations on the Work Safety of Construction Projects regulate the duties and responsibilities of supervision company and supervision engineer，reorganize these regulation and conclude the criminal law risks，the administrative law risk and civil law risks of supervision engineer. At the same time，the paper analyzes the causes of these risks，puts forward the prevention idea included “focus on prevention”，“process monitoring” and “relief afterwards”.
