摘要：框架合同在建筑业得到越来越多的应用，但现有法规缺少对框架合同性质和功能的定义，缺乏相应的理论依据。在此背景下，以房地产和建筑企业为目标群，通过调研、调查等形式收集此类企业所采用的各类框架合同模板，从合同法理和框架合同模板内容中提炼其共同特点，分析确定框架合同关系契约的本质，并从经济学和社会学两个方面对框架合同的功能进行研究，理清框架合同的应用价值与效能。

Abstract：Framework contract has been widespread applied in the economic transaction，but there is no definition of character and function of framework contract，and less of theoretical basis. Under this underground，taking the real estate and construction enterprise as objects，through investigate and survey to collect the framework contract templates which used in those enterprises，abstracts the common characteristic of framework contract based on the legal principle and framework contract templates，analyses and confirms the relational contract character of framework contract. The study researches from economics and sociology two aspects，makes sure the applied value and usefulness of framework contract.
