[摘　要]　建设工程施工合同是发承包双方依据国家相关法规签订的法律文书，为规避合同履行风险，要从源头即合同洽谈过程加强风险控制。结合工程实例，通过对合同协议书、通用合同条款和专用合同条款中风险控制点的分析，从发包人的角度重点介绍施工总承包合同洽谈过程中规避合同风险的有效途径。

Abstract: The construction contract is the documents signed by both sides according to the relevant lawsand regulations. We should strengthen risk control from the contract negotiation process to avoid the risk of the contract. Combining with the project cases and the analysis of risk control point in contract agreement, general terms of the contract and the special terms of the contract, this paper mainly introduces the effective ways of avoiding risks in the negotiation of general contract of construction from the employer's point of view.
