[摘　要]　针对当前我国建设市场中存在的工程转包与违法分包现象，从现行法律法规的角度，结合工程案例，分析工程转包与违法分包的危害，并从政府主导、市场监督、业主监管三个方面提出防范措施与建议，供业内人士参考。

Abstract: For the phenomenon of subcontract and illegal distribution exist in the current construction market of China, from the perspective of the existing laws and regulations, combined with the project case, analyses the harm of subcontract and illegal distribution, puts forward preventive measures and suggestions from the government leading, market supervision, the owners supervision three aspects, for the industry to refer.
