建筑设计行业从业资格挂靠法律关系分析

[摘 要] 建筑设计行业从业资格挂靠常常引发劳动争议。从理论和实践角度探究劳动合同的认定标准,以此为基础认为建筑设计行业从业资格挂靠不应属于劳动关系范畴。为减少由此引发的争议,防范法律风险,建筑设计企业应当加强人事管理,通过完善招聘制度、兼职制度来规避从业资格挂靠风险。

Abstract: Attached of occupational requirement in architectural design industry often incurs labor disputes. This paper explores judging standards of labor relation from theory and practice angles. Based on it, considers attached of occupational requirement in architectural design industry should not belong to category of labor relation. In order to decrease disputes caused by attached of occupational requirement, and prevent legal risk, architectural design industries should strengthen personnel management. To avoid risk of attached of occupational requirement through perfect the systems of recruitment and concurrent job.
