[摘　要]　根据多年的执业经验，总结建筑企业在施工合同缔结中遇到的显失公平条款的主要类型，指出产生显失公平条款的根源在于合同双方地位的不平等，提出防范显失公平条款应注重事前的“防”、事中的“补”、事后的“敢”，同时在社会层面发挥行业协会的“抱团”作用。

Abstract: According to the author's practice experience for several years，summarizes that the main types of unfair terms in construction contract of construction enterprises. Points out that the root causes of unfair terms in construction contract lie in the unequal status between both sides，and puts forward that to prevent unfair terms construction enterprise should be mainly attention to the “proof” in advance、the “repair” in the matter、the “courageous” afterwords. At the same time, the industry associations should play a role of “hold together” at the societal level.
