[摘　要]　基于建设工程招投标案例，分析投标保证金制度存在的缺陷，并提出对策建议，以减轻建筑企业的负担，使其大量被占用且闲置的投标保证金发挥效益。

Abstract: Based on the practice of construction bidding, analyzes the defects of tender deposit system, and proposes some countermeasures to reduce the heavy burdens of construction enterprise by making its massive occupied but idle tender deposit bond benefit.
