[摘　要]　针对5·12汶川大地震后承发包人在合同履行中存在的问题，提出了解决办法，有助于承发包人今后完善建设工程施工合同条款，明确地震导致的费用分担办法，为顺利履行合同创造条件。

Abstract: Combining the problems during the execution of the contract after the 5·12 Wenchuan earthquake, this paper brings forward some solutions, which can help the contractors improve the contract clauses and define the sharing methods of the cost caused by the earthquake，so as to guarantee the smooth execution of the contract.
