住宅质量保险的立法模式与制度选择

[摘 要] 住宅质量保险对于保护业主的合法权益具有重要意义。成功开展住宅质量保险的国家大都通过立法推行强制保险,而我国仍然采用自愿保险。由于存在政府政策引导失误与配套制度缺失等问题,这项制度在我国呈现推而不行的状态。为了从根本上遏制当前住宅质量问题频发的态势,必须将业主的合法利益放在首位,构建符合我国国情的住宅质量强制保险制度,并在操作层面优化现行的住宅质量保险运行机制。

Abstract: Housing quality insurance is of great significance to protect the legal rights and interests of owners of house. While almost all the countries which carry out the housing quality insurance successfully adopt the mandatory insurance by enacting new laws, China still adopt the mode of voluntary insurance. Due to the misplay of governmental policy guiding and the absence of relevant system, the implementation of housing quality insurance system encounters many barriers. In order to contain the trend of increasingly emerging of bad quality housing fundamentally, we must put the owners' legal rights and interests in the first place, conceive a housing quality mandatory insurance system in conformity with the situation of our country, and optimize the operational mechanism of existing housing quality insurance from operational level.
