基于建设项目履约周期的招标规则的改进研究

[摘 要] 建设工程招标是建设工程合同的订立过程，其规则制订不能仅从招标本身入手，而要综合建设项目的施工周期和合同的履行过程等因素来加以考虑。就此采用博弈分析的方法，以建设项目施工过程中的履约有效性为出发点，对于建设工程项目招标规则的制订，进行理论上的分析与研究，提出新的招标规则。[关键词] 招投标；维克里规则；履约周期；博弈论Abstract: Tendering and bidding is the initial process of contracting. Not only the tendering process could be considered in the designing of bidding regulations, but also the process of contract performing, the construction process. Based on Game Theory, beginning with the effectiveness of the construction performances, this paper studies and analyzes the design of bidding regulations.
