[摘　要]　合同法与学说及实务对工程变更的观点不尽一致。为探析工程变更的含义及其与施工合同变更的关系，通过相关概念整理及学术观点分析，提出工程变更是施工合同变更的原因之一，并深入分析施工合同变更的原因、构成要件及法律效果。依此分析可判断工程上的变动是否构成施工合同变更。

Abstract:  The rules of the engineering change in Contract law are not congruent with the theory and practice of that. In order to explore the relationship between the engineering change and construction contract, this paper, through arranging and analyzing the relevant concepts and academic views, puts forward that the engineering change is one of the causes of construction contract change, and then analyzes deep the causes of construction contract change, constitutive requirements and legal effect, which can determine the engineering whether results in the change of construction contract.
