[摘　要]　针对目前结算中存在的问题，文章根据现有的法律规定，分析无效施工合同恢复原状兼顾过错的结算原则，在此基础上，研究如何合理地结算无效施工合同的工程款，并进一步探讨折价补偿和损害赔偿工作的具体内容。

Abstract: According to the existing law and the existing problems in settlement, this paper elaborates the settlement principle of reinstatement, combined with faults, to invalid construction contracts. On this basis, researches on how to settle up in invalid construction contract, finds out that the coral procedures are discount compensation and damage compensation, and further discusses how to carry out the discount compensation and damage compensation work specifically.
