“小产权房”的法律性质及解决对策分析

[摘 要] 针对近年来我国社会公众广泛关注的很多大中城市“小产权房”规模巨大、愈演愈烈的复杂问题,首先界定“小产权房”的概念内涵,分析其产生的原因、各主体的违法责任和违法占用土地的性质,提出区别对待的处理办法,即坚决拆除、在一定的条件下逐步合法化予以确权、政府购买改造成保障性住房,以及加快“城中村”改造来推进“小产权房”问题的解决。

Abstract: The “small property room” issue has become a large-scaled existing and increasingly serious problem in China’s society with a wide public concern. Based on the problem, the article begins with the definition of the “small property room”, followed by the analysis of its reasons. Then, the author discussed the nature of the illegal occupation of land and the illegal responsibility of different subjects. At last, the article proposes flexible solutions to solve the “small property room” issue, namely, determinedly demolishment、the gradual legalization under certain conditions、transformation into the“indemnificatory housing” through the government purchase、 and the accelerated reform on the “urban-village”.
