从法经济分析角度看商品住宅项目强制招标

[摘 要] 关于强制招标项目范围的法律规定,历来备受业界争议。商品住宅项目不分主体、不分资金来源,一律需要招标的做法,无论实践效果还是社会反映均不理想。本文从法经济分析的角度对商品住宅项目强制招标的规定进行了成本与收益的定性分析,指出商品住宅项目强制招标是一项过剩的法律供给。[关键词] 商品住宅项目,强制招标,法经济分析Abstract: The law about mandatory bidding project scope is always a subject to be dispute in the industry. From the practice results and the social reflection, it is not an ideal provision that a commodity residence project must choose suppliers and construction units by bidding, regardless of the nature of its development unit and funding sources.
