［摘　要]　我国《招标投标法》和《建筑法》对联合投标有不同的规定，导致对投标联合体的资质是否符合法规有对立的认识。本文从逻辑结构、效力、适用条件等方面对相关法规分别进行分析比较，尤其对是否违反《建筑法》进行了深入论述，最后对招标人设定招标条件提出了合理建议。

Abstract: Different rules of joint bidding in the Bidding Law and the Construction Law, so there are opposite understandings about whether the qualified of joint bidder is legitimate. This paper compares these laws and statutes from the aspects of logic structure, effect and applicable condition and so on, especially discusses in-depth about whether violate the Construction Law, at last put forward a reasonable proposal on setting the tender conditions.
