[摘　要]　从合同调价条款的约定引入情事变更原则，再从其适用条件探讨情事变更原则应用的局限性，并辅以一个实际判例来说明承包人在签订不可调价款合同时应尽可能全面考虑自身应该承担的风险责任，而不能依赖于情事变更原则的保护。

Abstract: This paper introduces the change of circumstance from the price adjustment terms, and analyses the limitation of the change of circumstance from its application conditions. By means of an actual case, it illustrates that contractors should consider the risk responsibility all sidely when sign the contract whose price is not adjustable, instead of relying on the protection of the change of circumstance.
