[摘　要]　以设计监造咨询服务为核心，对设计单位及其工程师和监理单位及其工程师的法定义务与责任、设计合同与监理合同的不同的法律性质、设计服务报酬与监理服务报酬进行研究，以推进设计监造咨询服务模式在我国的发展。

Abstract: This paper demonstrates different statutory duty and liability of design company and its engineers & supervision company and its engineers, different legal nature between design contract and supervision contract and two different service fee. The results would be very important for promoting Architect/Engineer（A/E） service in China.
