基于完工保证的商品房预售管理优化研究

摘要:国内外实践经验表明:引入完工保证机制是商品房预售管理优化的突破点。在该机制作用下,由专业保证机构提供担保,确保预售项目按期交付与办理产权。专业保证机构的核心业务涵盖项目的风险评估、交易审核、过程监控与违约赔付,经研判具备本土商业可行性。本研究最终以完工保证机制为核心,整合预售许可、资金监管与产权保障三项关键制度,构建出“一核三维”的新型预售管理框架。关键词:完工保证;商品房预售;预售资金监管;预售产权Abstract:Both international and domestic experience indicates that introducing a completion guarantee mechanism represents a key breakthrough in optimizing presale management for commercial housing. Under this mechanism,professional surety institutions provide guarantees to ensure timely delivery and property title registration for presale projects. The core functions of these institutions-including risk assessment,transaction review,progress monitoring,and default compensation have been evaluated as commercially viable in the local context.
