摘要：与传统发包模式不同，设计施工总承包项目实践中的部分设计由承包商完成，在设计审批阶段双方对于承包商的设计成果是否满足合同要求有着不同的判定标准，因此容易产生争议，而争议能否及时解决则影响着整个项目目标的实现。本文通过分析设计施工总承包模式下两阶段设计控制权的配置问题引出业主与承包商之间的设计审批争议，接着探究设计审批争议的成因并对三种不同类型事件驱动下的设计审批争议案例进行分析，最后针对这三种成因提出应对策略以供实践参考。

Abstract：Different from the general contracting mode，parts of the design in the practice of the design and construction general contracting project is completed by the contractor，and in the design approval stage，the two parties have different criteria for judging whether the contractor’s design results meet the requirements of the contract，so it is easy to have disputes，and whether the disputes can be resolved in time affects the realization of the entire project objective. This paper analyzes the control configuration problems of two-stage design under the design-build mode to lead to the design approval disputes between the owner and the contractor，then explores the causes of the design approval disputes and analyzes the cases of design approval disputes driven by three different types of events，and finally proposes the response strategies for these three causes for practical reference.
