摘要：推行过程结算涉及市场主体利益的深层次调整，是建筑业的一次重要变革。简述施工过程结算管理中存在的主要问题，从国家政策背景、政策内容及司法判决等多个视角深度探究，得出施工过程结算行为的性质应是法律行为而非事实行为的结论；对过程结算的节点划分、价款范围、确认及支付等管理关键问题明确管理原则、提出管理要点；立足市场政策完善和主体能力提升，构建项目全过程、全要素和全方位的全面过程结算管理体系。

Abstract：The implementation of process settlement involves the deep-level adjustment of the interests of market players，it is a major change in the construction industry. The paper briefly describes the main problems in the implementation of construction process settlement，and explores the nature of construction process settlement which should be a legal act rather than a factual act from various perspectives，such as national policy background，policy content and judicial decision. Then，clarifies the key management issues such as node division，price range，confirmation and payment of process settlement，and proposes the key management points. Establishes the improvements of policy and ability are paid attention，and the comprehensive management system of the process settlement from the whole process，factors and directions of projects.
