摘要：本文以江苏省法院相关典型司法判决为主要研究资料来源，进行深入分析，提炼出“合同约定不清”、“工程变更”、“材料价格波动”与“合同终止”等四类典型的合同价款争议，并提出争议防范建议，以期为发包人更加科学、合理地使用固定总价合同和有效防控上述风险提供参考。

Abstract：The paper puts forward fourtypical payment disputes including unclear contract clauses，variations，material price fluctuation and contract termination according to deep analysis on relevant construction dispute judgments mainly from courts in Jiangsu province. And proposes suggestions on prevention of these four disputes，so as to provide reference for employers reasonably to use fixed-price contract and contractor scientifically and effectively and avoid relevant risks at the same time.
