建设工程质量监管的机制失灵与制度补救-以上海“莲花河畔景苑”楼房整体倾覆案为视角

[摘 要] 工程质量事故频频发生的根本原因在于政府工程质量监管机制失灵。政府工程质量监管机制失灵的原因又在于,核准制改为备案制进一步刺激“经济人”的逐利性,事后监管助长政府对工程质量的形成过程不作为,行业陋规加剧工程建设资金实际投入不足,业主在建设工程质量验收过程中严重缺位。应当恢复核准制度,加强政府的工程质量监管责任,严格市场准入门槛,严格规范工程合同行为,支持业主的房屋验收权利,积极发展房屋验收中介机构,以充分发挥建设工程质量监管机制的效用。

Abstract: Accidents of construction quality happen frequently,and fundamental reason lies in mechanism failure of construction quality control by government. The mechanism failure of construction quality control also results from all kinds of reasons,such as transforming approval system to recording system further stimulates the profit-driven nature of “economic man”, post-regulation contributes to the omision of government in control of constuction quality, bad habits in construction industry aggravates the lack of construction funds invested actually , and the owners are seriously absent in the acceptance check of the construction quality.Therefore,in order to fully exert the effectiveness of the mechanism regard construction quality control,we should restore approval system,enhance the government's responsibility for construction quality control, strict the threshold of market access, regulate the behavior of construction contracts strictly, support the owners' rights in housing acceptance check and actively develop intermediaries of housing acceptance check.
