摘要：随着EPC、PPP等工程建设模式的发展，联合体投标越来越普遍，本文以联合体制度价值为基础，结合对招投标法和实施条例中相关规定的理解，以招标、评标和中标签订合同为论述主线，探讨招标人拒绝联合体投标、联合体能力和资格的评定以及联合体中标合同的签订等问题，重新解读招标人对联合体投标的拒绝权，总结提出联合体能力资格的评价思路，并对联合体“共同签订”合同提出实务操作层面上的建议。

Abstract：With the development of EPC，PPP and other engineering models，joint venture’s bidding is becoming more and more popular. Based on the value of the joint venture system and the understanding of the relevant clauses of the bidding invitation and bidding submission law and the implementing regulations，this paper aims to discuss problems such as the tenderer’s right to refuse joint venture’s bidding，the evaluation of the joint venture’s ability and qualification，and the signing of the winning contract of the joint venture，taking bid invitation，bid evaluation and winning contract as the main line of narrative. Reanalyzes the tenderer’s right to refuse joint venture’s bidding，concludes the methods of evaluating the joint venture’s ability and qualification，and puts forward some practical suggestions on the “co-sign” of the joint venture’s winning contract.
