[摘　要]　从项目治理角度对“代建单位的选择”这个核心问题进行了研究，通过对代建制实施的现状进行分析，发现存在缺乏代建单位选择方式的程序性规定、缺乏代建单位考评信息披露机制及代建单位隐性激励机制等问题，从项目治理的角度通过建立代建单位名录来改进现有的招标方式。并进一步对比浙江、青岛、武汉、福建、宁波等地区在地方规定性文件中有关代建单位名录的做法，从而得到代建单位名录的可操作性思路。

Abstract: From the viewpoint of project governance, it studies the selection of construction agent. Some problems of selecting construction agent are found by statistical analysis, such as the lack of the selection procedure regulation, evaluation information disclosure, and so on. Solving the above problems by introducing project governance, this paper analyzes the establishment of construction agent list as a valid way to improve the selection method of public bidding. Furthermore, considered the practice of construction agent list among some areas such as Zhejiang, Qingdao, Wuhan, Fujian and Ningbo, it obtains some operable thoughts.
