外派劳务合同的特征及法律的适用

[摘 要] 针对目前我国劳务(雇佣)合同立法缺失所导致的人们对外派劳务合同法律关系的认识莫衷一是,及仲裁和审判实践的矛盾与冲突,从分析外派劳务合同与劳动合同的不同特征入手,揭示了两者之间是平等民事主体之间的民事法律关系和不平等民事主体之间的劳动法律关系的本质区别,并依据现行法律法规规章及规范性文件,阐述了处理外派劳务合同纠纷应当适用的法律及依据。

Abstract: Aiming at the legislation lack of labor contract in our country at present, leading to inconsistent cognition to contract legal relationship of labor sent abroad, contradiction and conflict of arbitration or adjudictation practise, the paper analyzes the respective characteristics of two contracts, reveals the essential difference of labor legal relationship between equal subjects and unequal civil subjects. Then, combining with laws, regulations and normative documents, it describes applicable basis for dealing with labor contract disputes of personnel sent abroad.
