摘要：首先梳理法国内在缺陷保险制度的作用机理，明确其制度的参与方、保险产品设计及运作流程。其次，解析我国上海试点工程质量保险制度的机理，进而探讨我国工程质量保险制度的实施障碍。最后，从优化产品设计、激励项目参与方和培养保险专业人才并培育风险管理机构方面提出应对实施障碍的对策，以期促进我国工程质量保险制度的发展。

Abstract：Firstly，this paper combs the mechanism of the inherent defect insurance system in France，clarifies the participants of the system，the design and operation of insurance products. Secondly，analyzes the mechanism of Shanghai pilot project quality insurance system，and then explores the barriers to the implementation. Finally，puts forward some countermeasures to deal with obstacles to implementation in terms of optimizing product design，encouraging project participants and training insurance professionals and fostering risk management institutions，so as to promote the development of China’s engineering quality insurance system.
