[摘　要]　对建设工程监理制度的形成过程和相关法律法规进行了梳理，同时从监理企业、从业人员、业主行为、市场环境以及政府监管五个方面描述了建设工程监理行业的现存问题。指出建设工程监理的制度矛盾是导致建设工程监理行业尴尬局面的根本原因，最后给出了相应的政策建议。

Abstract: This paper introduces the formation and the relevant laws & regulations of construction supervisory system, and the existing problems of construction supervisory industry from construction supervisory company, professionals, owner′s conduct, market environment and government supervision. It points out that contradictions of the system are the root factors that cause the current awkward situation of construction supervisory industry, and gives several policy suggestions at last.
