摘要：基于印度项目涉及的银行保函有效期与索赔期问题，分析印度G项目履约保函条款，得出保函有效期与索赔期存在本质上的区别，并不是中印两国银行所主张的“两者没有区别”。保函的受益人必须在保函到期日之前作出符合规定的索兑请求，应于索赔期到期前保证开证行能收到这份请求，只有这样才能成功索兑保函金额。

Abstract：Based on the issue of the validity period and the claim period of the bank guarantee in Indian projects，this paper analyzes the performance guarantee clause of Indian G project，the results show that the validity period is essentially different from the claim period，which is completely contrary to “both periods making no difference” that advocated by bank of China and India. The beneficiary must make a matching claim before the expiry date of the guarantee，and the issuing bank should be able to receive the request before the expiry of the claim period，in order to successfully claim the amount of the guarantee.
